Considerations Before Seeking a QDRO

Before starting the process of seeking a Qualified Domestic Relations Order (QDRO), it's important to consider the following information:

  • Is the participant entitled to a benefit under an employer retirement plan?
  • If you're a participant, you can call your benefits center to get your benefit information.
  • All other people can work with the participant or the participant's attorney for participant-specific information. Sometimes it may be necessary to subpoena the information from the employer.
  • The participant can be restricted from retirement plan activity once the Qualified Order Center receives a draft domestic relations order, court order, or joinder.
